The Concept: The Soif de Coeur concept relies on the chance dating or meeting between two persons having purchased a bottle of Soif de Coeur each. On the inner side of the back label of the Soif de Coeur bottle is printed a unique code that can be seen the bottle once emptied. The validity of the code is two years after the year printed on the bottle. Two codes will become a match when the system will find compatible data between two registered persons.

The Service: Soif de Coeur is a free Service to the person who has bought a bottle of wine Soif de Coeur. Once registered as a member you can use the Service. When buying a bottle of Soif de Coeur, you have access to the secret code, once the bottle empty you can read the code on the inner side of the back label. This code is unique.
The Service enables you to participate by fill in the form and entering this secret code. Once the code is entered the search is activated. You can enter as many codes you wish as long as the codes are valid.

Eligibility
You must be eighteen or over to participate to this service. By using this website, you represent and warrant that you have the right, authority and capacity to enter into this agreement and abide by all of the terms and conditions of this agreement.

Registration and subscription
To become a Member you must register on the website. You agree to provide accurate, current and complete information about yourself, and to maintain and update your information to keep it accurate, current and complete. You agree that we may rely on your Registration Data as accurate, current and complete. You acknowledge that if your Registration Data is untrue, inaccurate, not current or incomplete in any respect, we reserve the right to terminate this Agreement and your use of the Site

You will not post your personal details such as your telephone number, fax number, address and/or e-mail address or URL in Your Profile or any other Information which would enable other Members and/or Users to contact You directly.

Information which breaches, infringes, violates and/or is contrary to any law, by-law, statute and/or regulation or code of conduct or any other parties' rights (including but not limited to Intellectual Property Rights and/or privacy rights).

You will not use the Service to promote another site, service and/or business in any way including but not limited to Posting any telephone number, fax number, address and/or e-mail address or URL in Your Profile.

You will not solicit other Members' business, advertise, buy or sell products and/or services through the Service.

You will not attempt to gain unauthorised access to any Information available on or via the Service or to any of the networks used in providing the Service.

You will not post and/or reproduce in any way any Information in which the Intellectual Property Rights belong to another party without first obtaining the prior consent of the owner of such rights.

In whole or in part any of the Information on the Website (including, but not limited to any Information contained in other Members’ Profiles), you will not other than for the purposes contemplated in this Agreement.

Term and termination

We may immediately terminate your membership and your access to the Service at any time because you have breached this Agreement and will send you notice of termination at the email address you provide in your application for membership or such other email address as you may later provide to us.

Limitation on liability
Except in jurisdictions where such provisions are restricted (and in that event liability is disclaimed to the fullest extent permitted by law), in no event will Omnivins be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the site or the ‘Soif de Coeur’ service, even Omnivins has been advised of the possibility of such damages. You further agree to hold Omnivins, including its officers, directors, agents, subsidiaries and employees harmless for claims arising in the event that other user’s profile ultimately proves to be offensive, harmful, inaccurate and/or deceptive. Notwithstanding anything to the contrary contained herein, Various, Inc.'s liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to ‘Soif de Coeur’ for the service during the term of membership.

Proprietary rights in content on Soif de Coeur

Soif de Cœur owns and retains all proprietary rights in the Website and the Service. The Website contains the copyrighted material, trademarks, and other intellectual property and proprietary information of Soif de Coeur, and its licensors. Except for that information which is in the public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, distribute, perform, reproduce, license, create derivative works from, transfer display, or sell or re-sell any such intellectual property or proprietary information.

Indemnity
You will indemnify, defend and hold harmless Omnivins, its officers, directors, employees, agents, representatives and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys' fees) relating to or arising out of your use of the ‘Soif de Coeur’ service, including any breach by you of the terms of this Agreement.
You are prohibited from using different usernames or email addresses in order to avoid and circumvent payments to Omnivins or misusing any of the ‘Soif de Coeur’ features or concept. Such acts shall result in a termination of membership.

Modifications of this agreement

We may alter or amend our terms and conditions upon giving reasonable notice in advance of such amendment taking effect. If upon receiving any notice, if you do not wish to continue with the Service, you may terminate the contract upon giving us notice, such notice to take effect upon the earlier of our receipt of your notice or the date upon which the amended terms and conditions would otherwise have taken effect. You will be deemed to have accepted any alteration and/or amendment if you continue to use the Service after the relevant period of notice has expired.

Disputes

If there is any dispute about or involving the website and/or the service using the website, you agree that the dispute will be governed by the laws of France without regards to its conflict of law provisions. You agree to personal jurisdiction by and venue in the courts of Bordeaux, France.
